These Terms & Conditions govern the use of the CallMyBot service (“the Service”), and the contractual relationship between you (“the User” or “the Client”) and PicoUX (“we”, “our”, or “the Company”).
By accessing or using the Service, you expressly and unconditionally accept these Terms and Conditions.
1. Purpose of the Service
The Service allows users to integrate voicebots on their website, as part of a SaaS subscription model.
2. Access to the Service
Access to the Service requires authentication via email address or via Google account. The user agrees to provide accurate, complete, and up-to-date information. The Company reserves the right to suspend or terminate any account in case of a breach of these Terms.
3. Pricing and Payment
Prices are listed in U.S. dollars ($) and include all applicable taxes, unless stated otherwise.
Payments are processed by our partner Dodo Payments, acting as the official merchant of record. Therefore, all billing, invoicing, and payment processing are subject to Dodo Payments’s terms, which you can view here: https://dodopayments.com/terms-of-use
No refunds will be issued, unless otherwise stated or required by applicable law.
4. Duration and Termination
Subscriptions renew automatically on a monthly basis unless canceled by the user through their account or the link provided in billing emails.
The Company reserves the right to suspend or terminate an account without prior notice in case of abuse or violation of these Terms.
5. Use of the Service
The user agrees to use the Service in compliance with applicable laws and regulations.
Any abusive, illegal, or unethical use of the Service is strictly prohibited.
6. Intellectual Property
All content on the Service (trademarks, text, interfaces, visuals) is the exclusive property of the Company. Any unauthorized reproduction or use is strictly prohibited.
7. Personal Data
Personal data is processed in accordance with our privacy policy.
Dodo Payments also acts as a data controller for payment processing purposes.
8. Limitation of Liability
The Service is provided “as is.” The Company does not guarantee the absence of errors, defects, or service interruptions.
Under no circumstances shall the Company’s liability exceed the total amount paid by the user in the last 12 months.
9. Modifications
We reserve the right to modify these Terms at any time. Users will be notified by email or in-app notification. Continued use of the Service following a modification constitutes acceptance of the revised Terms.
10. Governing Law and Jurisdiction
These Terms are governed by French law. In the event of a dispute, exclusive jurisdiction is granted to the courts located in the jurisdiction of the Company’s registered office, unless otherwise required by applicable law.
